Terms and conditions

 

1. Introduction

- Travel Moments,

service business and travel agency,

owner Ante Jelaska, Iločka 12, Split,

( hereinafter: "Travel Moments", "company", "we", "us" or "our", etc.) owner

of the website "https://www.travelmoments.hr/" and provider of the services,

for example: transfers, tours, taxi, etc.

(collectively or individually "service").

 

- You 

(hereinafter: "user", "customer", "client", "traveler", "your", etc.) means a person who uses our website and/or a person who orders services from our company or any visitor to our website.

 

- Partner refers to an external service provider, which if necessary

  we hire to perform services and/or activities.

 

2. Security of personal data

 

If you want to book and use any of our services, you may have to provide certain data solely for further communication and for the performance of the reserved services, including, without limitation, your name, surname, e-mail, and mobile phone number.

3. Communications

 

By using our websites and/or booking our service, you agree to subscribe to newsletters, marketing or promotional materials, and other information that we may send, however, you may opt out of receiving any or all of these communications by emailing a request to

travelmoments365@gmail.com ".

 

4. Payment methods

 

A) On our website through third-party services: Payment Provider, payment link  “pay by link” that we may also send to you by email. We do not collect credit card information.

 

B) By bank transfer, the customer will receive bank account information via e-mail. After receiving the payment, we will send the customer a confirmation by e-mail and all the details regarding the ordered service. We ask that all international transfers be made according to our instructions, which means that all bank charges are paid by the customer.

 

C) In person via POS (cards or cash)

 

5. Cancellation

 

- Cancellation of the service by the user

 

All cancellations by the user must be in writing via email. The date when the cancellation is received by e-mail is the basis for the refund of cancellation costs according to the conditions stated below:

 

- Cancellation of the service 24 hours or more before the service date, the client can cancel free of charge

 

- If the client does not show up "no-show" without canceling or cancels the service less than 24 hours before the service date, the company has the right to keep all the money paid from the total price of the service.

 

- Cancellation of service by the company

 

Our travel plan (itinerary) can be changed depending on abilities and circumstances (eg insufficient number of travelers, unfavorable weather conditions, extraordinary circumstances, which could not be foreseen or avoided, etc.). We reserve the right to change the travel plan without prior notice. In case of major changes or cancellation of a specific service, we will inform the traveler as soon as possible and offer the following options:

 

1. The traveler can accept a new departure date or destination

2. The traveler can accept a substitute service, equivalent, or similar itinerary

3. The traveler can cancel the reservation and receive a full refund of the money paid

 

The traveler is obliged to inform us about the choice of the offered option no later than one (1) day before the date of service provision, if the traveler does not do so, we reserve the right to choose one of the options instead.

6. Extreme weather conditions

We reschedule the activity in case of extreme weather conditions, or extraordinary circumstances, which could not have been foreseen or avoided, or have occurred immediately. The activity is then rescheduled for a day or two – before or after the date booked. If the change is not possible, the payments will be refunded in full amount.

 

7. Content

 

Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content you post on or through our website, including its legality, reliability, and suitability.

 

8. Links to other websites

 

Our website may contain links to third-party websites or services not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not guarantee the offer of any of these entities/individuals or their websites.

 

9. Recording and photography

 

By using our service, the client consents to the interview(s), photos, audio, and video recordings and their publication, or reproduction that can be used for news, online announcements, promotional purposes, and advertising by the company. You release the company, its owners, employees, and all other persons involved in the photography from any responsibility in connection with the recording, digitization, or publication of interviews, photographs, videos, and/or audio recordings.

 

10. Analytics

 

We may use third-party service providers to monitor and analyze the use of our website and service.

 

11. Limitation of liability

 

In no event shall Travel Moments, nor any of its owners, employees, or partners be liable for anything arising out of or in any way related to your use of our website and any of our services, whether or not liability under contract or otherwise. Travel Moments, including the owner, employees, and partners, shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of our website and our services.

 

12. Force majeure

 

Travel Moments accepts no liability and will not pay any compensation if it is

performance of our obligations and services or the partner's obligations and services prevented or on which is directly or indirectly affected by force majeure or any circumstances beyond our reasonable controls, including but not limited to adverse controls weather conditions, natural disasters, traffic jams.

 

13. Behavior of travelers

 

We reserve the right to deny access to the service to any person and persons deemed unfit to travel and/or use the services or whose actions may endanger or disturb other travelers, our staff our partners' staff, or the public or cause property damage. In addition, your contract with us may be terminated and you will not be entitled to a refund or compensation. Neither Travel Moments nor any of its owners, employees, and partners will be liable for accidents, injuries, losses, or damage caused by inappropriate behavior of travelers, including behavior under the influence of substances of any nature (drugs, medication, alcohol ...).

If any traveler damages or breaks anything during the provision of the service, they are responsible for paying compensation according to the damage reports and invoices issued by the relevant organization. The traveler can pay compensation on the spot in cash if the injured party agrees. Failure to pay will result in additional liability for court costs incurred as a result of filing a lawsuit against the guilty party.

By using the Travel Moments services, you agree to pay compensation for the damage and lost profits you cause.

14. Complaints and claims

 

- If the traveler, during the provision of the service, submits a complaint/complaint due to non-fulfillment, partial fulfillment, or irregular fulfillment of the contracted services, he/she will follow the instructions of the service provider and cooperate in eliminating the cause of the complaint. Immediately after noticing a deficiency on the spot, the traveler is obliged to submit a complaint to the driver/guide / or representative. The traveler must cooperate in good faith to eliminate the causes of complaints. If the traveler on the spot does not accept the offered solution that corresponds to the contracted service, Travel Moments does not have to accept the traveler's subsequent appeal/complaint.

 We will consider the refund request invalid if we are not notified in time. All refund requests are sent in writing within 2 days of the submitted complaint/complaint. If we determine that the claim is founded, the traveler has the right to monetary compensation exclusively in the amount of the actual value of the services that were not provided. The court in Split, Croatia is competent for all possible disputes.

15. Luggage

 

Travel Moments is not responsible for luggage, whether destroyed or lost, as well as for the theft of luggage or valuables in the means of transport. The traveler is obliged to take care of his belongings brought into the means of transport, and he is obliged to take them with him every time he leaves the means of transport. The transport of pets is not allowed, except in exceptional cases, upon request and with an extra charge. We cannot guarantee the fulfillment of such a request.

 

16. Law and jurisdiction

 

Croatian law applies to these terms and conditions. You are subject to the jurisdiction of courts located in the Republic of Croatia. You agree to resolve all disagreements peacefully and by agreement, and in case of dispute, the court in Split, Croatia has jurisdiction.

 

17. Changes to the service

 

We reserve the right to withdraw or change our services and their content at our sole discretion, without prior notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time we may restrict access to some parts of the Service or the entire Service.

 

18. Amendments to terms and conditions

 

We reserve the right to change the terms and conditions at any time by posting the changed terms and conditions on our website.

19. Source and translations

 

The original of these terms and conditions is in the Croatian language.

Translations into other languages are for illustrative purposes only.

 

20. Legal provision

 

If any of the terms and conditions is deemed by a court to be invalid, illegal, or unenforceable for any reason, such terms and conditions shall be terminated or limited to the minimum extent, so that the remaining terms and conditions shall continue in full force and effect.
